DISTANCE SALES AGREEMENT

1. PARTIES

This Agreement has been signed between the following parties under the provisions and conditions specified below.

By accepting this contract, the BUYER agrees in advance that if the BUYER confirms the order subject to the contract, he/she will be obliged to pay the order price and any additional fees such as shipping costs, taxes, etc., and acknowledges that he/she has been informed in this regard.

2. DEFINITIONS

The following terms in this contract shall express the explanations written next to them for the application and interpretation of this contract.

SELLER: The company providing goods to the consumer within the scope of commercial or professional activities or acting on behalf of the company providing goods,

BUYER: The real or legal person acquiring, using, or benefiting from a good or service for non-commercial or professional purposes,

SITE: The internet site belonging to the SELLER,

ORDERER: The real or legal person who requests a product or service via the SELLER's website,

PARTIES: The SELLER and the BUYER,

CONTRACT: This contract concluded between the SELLER and the BUYER,

GOODS: Moveable goods subject to purchase and intangible goods such as software, sound, image, and similar prepared for use in electronic media.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the product specified below, the characteristics and selling price of which are specified below, which the BUYER orders electronically from the SELLER's website, in accordance with the provisions of Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts.

The prices listed and announced on the website are the selling prices. The announced prices and promises are valid until updated and changed. Prices announced for a specific period are valid until the end of the specified period.

8. The basic features (type, quantity, brand/model, color, quantity) of the product(s)/service(s) are published on the SELLER's website. If the Seller has organized a campaign for the relevant product, you can review the basic features of the relevant product during the campaign period. It is valid until the campaign date.

7.2. The prices listed and announced on the website are the selling prices. The announced prices and promises are valid until updated and changed. Prices announced for a specific period are valid until the end of the specified period.

7.4. The shipping cost, which is the shipping expense of the product shipment, will be paid by the BUYER.

9. GENERAL PROVISIONS

9.1. The BUYER acknowledges, declares, and undertakes that he/she has read and informed himself/herself about the basic features of the product subject to the contract, the selling price, the payment method, and the preliminary information about the delivery on the SELLER's website and confirms the Preliminary Information electronically before the conclusion of the distance sales contract. The BUYER acknowledges, declares, and undertakes that he/she has correctly and completely obtained the address to be given by the SELLER before the conclusion of the distance sales contract, the basic features of the products ordered, the price of the products including taxes, payment and delivery information.

9.2. Each product subject to the contract shall be delivered to the person and/or organization at the address indicated by the BUYER or BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence for each product, provided that it does not exceed the legal 30-day period.

9.3. The SELLER shall be responsible for delivering the product subject to the contract in a sound, complete, in accordance with the qualifications specified in the order, and with the warranty documents and user manuals, if any.

9.4. For the delivery of the product subject to the contract, the signed copy of this contract must be delivered to the SELLER and the price must be paid in the form of payment preferred by the BUYER. If, for any reason, the product price is not paid or is canceled in the bank records, the SELLER shall be deemed to be free from the obligation to deliver the product.

9.5. If the bank or financial institution does not pay the price of the product to the SELLER due to the fact that the credit card belonging to the BUYER is used unfairly or unlawfully by unauthorized persons after the delivery of the product, the BUYER must return the product subject to the contract to the SELLER within 3 (three) days, provided that the product delivery fee is covered by the SELLER.

9.6. If the SELLER cannot deliver the product subject to the contract within the due period due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation, it is obliged to inform the BUYER of this situation. In such a case, the BUYER may use one of the rights to cancel the order, change the product subject to the contract and/or postpone the delivery period until the obstacle is eliminated. If the BUYER cancels the order, the amount paid shall be paid to him/her in cash and in lump sum within 14 days at the latest.

9.7. For the delivery of the product subject to the contract, this contract must be approved electronically, and if the price of the product subject to the contract is not paid for any reason or canceled in the bank records, the SELLER shall be deemed to be freed from the obligation to deliver the product.

10. RIGHT OF WITHDRAWAL

The BUYER may exercise his/her right of withdrawal from the contract within 14 (fourteen) days from the delivery of the product to himself/herself or to the person/organization at the address indicated. In order to exercise the right of withdrawal, a written notice must be sent to the SELLER by registered mail, fax or e-mail within this period and the product must not be used within the framework of the provisions of the "Products for Which the Right of Withdrawal Cannot be Used" as specified below.

11. PRODUCTS THAT CANNOT BE USED FOR THE RIGHT OF WITHDRAWAL

The following products cannot be returned due to their nature:

a) Products that are prepared in line with the consumer's requests or clearly personalized,

b) Goods that are likely to deteriorate rapidly or whose expiration date will expire,

c) Products with protective elements such as packaging, tape, seal, package, etc. which are opened after delivery; (It is mandatory to send the invoice of the product being returned.)

d) Goods that cannot be returned due to health and hygiene issues if the package is opened by the BUYER after delivery,

e) Products that are mixed with other products after delivery and cannot be separated by their nature,

f) Products that cannot be returned in line with the relevant legislation or the provisions of the Regulation published by the Ministry of Customs and Trade.

12. EFFECTS OF WITHDRAWAL

In the event that the BUYER exercises his/her right of withdrawal,

a) If the BUYER returns the invoice of the product to the SELLER, all kinds of payment made for the product and including the delivery charges, if any, are returned to the BUYER within 14 (fourteen) days from the receipt of the withdrawal notification to the SELLER.

b) If the original invoice is not sent, VAT and other legal obligations, if any, are not refunded, and the product price is returned within 14 (fourteen) days following the receipt of the withdrawal notification by the SELLER. The delivery cost of the product to the SELLER due to withdrawal belongs to the BUYER.

c) The product subject to withdrawal must be delivered complete and undamaged, together with the box, packaging, and standard accessories, if any.

d) The SELLER shall return the total price and the documents that put the BUYER under debt to the BUYER within 10 days from the receipt of the withdrawal notification and collect the goods within 20 days.

e) If there is a decrease in the value of the goods due to the fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the damages of the SELLER at the rate of fault.

13. AUTHORIZED COURT

In the implementation of this contract, the Consumer Arbitration Committees and the Consumer Courts in the settlement of the BUYER or the SELLER are authorized up to the value announced by the Ministry of Customs and Trade.

14. ENFORCEMENT

This contract has been issued for the sale and delivery of the products specified above by the BUYER electronically, and the SELLER's system records are considered as conclusive evidence in the determination of the implementation of the contract.
